Promise to Pay: Member promises to pay to Pink Iron Fitness their initial payment, to our fitness facility at the address shown above unless Pink Iron sends a written notification to make payments to a different address, notwithstanding this promise to pay. Members may elect to terminate their membership and make this agreement by providing written notice of cancellation at least 30 days in advance of termination. Failure to comply with these requirements will invalidate the notice of cancellation.
My failure to regularly attend and utilize the Fitness facility does not relieve me of my obligations, regardless of the circumstances I must pay the installments in full. I understand that I should expect from the information provided, my membership is non-cancelable. Should I default, I agree to pay all costs of collection, including but not limited to Collection Agency up to 50% of the unpaid balance, court costs, and reasonable attorney’s fees all of which may be paid or incurred by the holder of this note. I also a free to pay the following fees:
1. Non- Sufficient Funds (NSF)- Pink Iron Fitness may charge up to a $25.00 fee for returned check. Pink Iron fitness will not accept a check for a monthly installment from any member who has returned checks.
2. Credit Card Chargebacks- Pink Iron Fitness may charge up to a $25.00 fee for a declined credit card charge.
3. Changes to ACH Accounts- If there any banks account changes made, Pink Iron Fitness must be informed of the changes 10 day prior to the draft date or there will be a $25.00 charge to the account.
4. Agreement Default Charges- A $25.00 default charge will be assessed to each month of the remaining scheduled payments once your account is in default.
5. All members are required to scan their membership card for entry. A replacement card fee of $10.00 plus tax will be charged if lost or stolen.
6. Members may request a printed copy on the membership agreement.
7. Maintenance annual fee of $49.00 (Due 90 days after membership commencement date, on the 15th day of that month.)
THREE OPTIONS IF YOU ARE NOT USING YOUR MEMBERSHIP
A. FREEZE- The fee is $40.00, plus tax. This will allow you to hold your membership for a period due to justified reason for up to three months or for as long as it is necessary (with medical proof). The 12-month agreement will be extended for the months of absence.
B. TRANSFER- If you have a friend or family member (18 years and older) who would like to take over your membership, they ca do so for a $49.99 fee, plus tax. They will be responsible for the remaining balance of your membership according to the terms of your current agreement. The Cancellation Clause is not applicable for transfer. Once the initial obligation of the membership has been fulfilled, this membership cannot be transferred.
C. CANCEL- So long as you are current on your installment obligations and in good standing with Pink Iron Fitness, you may cancel this Agreement by providing a written notice of cancellation at least (30) days in advance of termination and making a payment $150.00. This option will cancel you from any further obligation with Pink Iron Fitness
